A King County Superior Court judge has tossed out a lawsuit seeking to decertify Barack Obama as a presidential candidate until the Democratic hopeful provided the state with proof he is a natural-born United States citizen.
The decision came down Monday. Superior Court Judge John Erlick’s three-page decision is attached as a pdf.
Erlick concluded:
The question of whether Senator Obama has, or does not have, the qualifications to serve as President of the United States is not presented in this action, because Plaintiff does not affirmatively assert that Senator Obama lacks those qualifications and offers no evidence on the subject…This Court makes no findings of face regarding Senator Obama’s qualifications.
