Drink up (just stay close to a bathroom)

That's a big gulp for freedom of refreshment: A New York state appellate court ruled that New York City Mayor Michael Bloomberg and the city's board of health overstepped its authority in banning sugary soft drinks in cups larger than 16 ounces. The court ruled that sugary drinks are not harmful in moderation and "cannot be classified as a health hazard per se."

But, the court said, Bloomberg can classify the following as "health hazards per se": hot dogs from sidewalk carts, nacho cheese sauce kept warm at 7-Eleven stores since 1997 and the Sashimi Tacos at Guy Fieri's American Kitchen.

Donk, donk: Before he died Monday at 69, Dennis Farina lent his voice for a guest role in the animated Fox comedy, "Family Guy." The former Chicago cop became an accomplished film and TV actor, most notably on NBC's "Law & Order."

It takes a thief -- just one: Lax security is being blamed in the $136 million jewel heist by a lone gunman in Cannes, France. The diamond show was on the hotel's ground floor and guards were few and unarmed.

It didn't help that the special exhibit was advertised as "Yoo-hoo! Jewel Thieves, Over Here!"
